| | Home>User Agreement | |  |  | | User Agreement | | | Please read this Citibank Online User Agreement ("Agreement") set out below, which includes disclaimers of liability and other important matters of interest to customers as users of Citibank Online facility. | | | In this Agreement the following terms shall bear the following meanings unless the context otherwise requires: | | | 1. | The Customer shall mean the authorized holder of CitiCard and/or Citibank Visa/MasterCard and/or the person who does not holds an account in Citibank which are requested and registered to received the Alert Service. | | | | | 2. | The person who holds an account in Citibank shall be defined as the "Existing Customer", meanwhile the person who does not holds an account in Citibank shall be defined as the "Temporal Customer". | | | | | 3. | Bank shall mean Citibank, N.A., Indonesia. | | | | | 4. | Business Day shall mean any day in which commercial banks are open for business in Indonesia, excluding Saturdays, Sundays and public holidays or any holidays of bank according to the prevailing Laws. | | | | | 5. | Transaction(s) shall mean any and all banking transaction(s) which is/are conducted by the Existing Customer via Citibank Online. | | | | | 6. | Alert shall mean the customized messages alert contained notice from time to time including but not limited to foreign exchange rate, product promotion and available balance information and other issues relating to Existing Customer's Bank account(s), as | | | | | | - A short messaging service and or an electronic mail and made available to the Existing Customer; or
- An electronic mail and made available to the Temporal Customer;
| | | At his/her request, at the sole discretion of the Bank and may be discontinued by The Bank at any time, upon prior notification. | | | | 7. | CSP shall mean the Cellular Service Provider with whom the Bank has an arrangement for providing the Alert service. | | | | | 8. | ISP shall mean the Internet Service Provider who provide internet connection to Customer. | | | | | 9. | SMS shall mean Short Messaging Service which is sent to Customer over his/her mobile phone. | | | | | 10. | E-Mail shall mean Electronic Mail which is sent to Customer, that is accessed via Customer Terminal. | | | | | 11. | Customer Terminal shall mean personal computer or similar devices which can directly access information and/or notice from the Bank. | | | | | Content | | Introduction -
| A CitiCard (including the number of CitiCard) or a Citibank Visa/MasterCard ((hereinafter each card referred to as the "Credit Card" and collectively referred to as the "Cards"), (including the "Credit Card Number" or the "Cards Number")), Automated Teller Machine (ATM) - Personal Identification Number ("PIN"), Credit Card - cash advance PIN ("Code") has been issued by the Bank, including the Existing Customer accounts from time to time opened and maintained with or made available by the Bank, all of which constitute as data connected to the operation system (the "System") which can be directly accessed via personal computers and/or similar devices ("Customer Terminal"). | | | The Customer via Customer Terminal which is connected to the System enable the Customer to received notice from time to time including but not limited to foreign exchange rate, product promotion and available balance information and other issues relating to Existing Customer's Bank account(s) through E-Mail and for the Existing Customer to carry out any banking Transaction(s) and other business Transaction(s) (hereinafter collectively referred to as the "Transaction(s)") by using the CitiCard and/or Credit Card. | | | The Existing Customer may also received the Alert through SMS which is sent over his/her mobile phone.In consideration of providing Citibank Online which has capability as mentioned above, the Customer hereby are aware of and agree to abide all articles set forth under this Agreement : | | | 1. | ACCEPTANCE. By using Citibank Online, the Customer has accepted, agreed and obeyed to be bound by all operational rules and the terms and conditions governing utilizing of Citibank Online facility set forth under this Agreement, and agreed to pay any fees which may be imposed associated with the use of Citibank Online facility. The Customer likewise agree to observe and be bound by any and prevailing laws, rules, regulations and official directive from the Bank which is applicable to Citibank Online. | | | 2. | RESPONSIBILITY. The Bank has the absolute discretion to make Citibank Online available to the Customer. The Bank has the discretion from time to time to determine the scope of Citibank Online in order to improve services to the Customer or in connection with malfunction, maintenance, repair, replacement of computer, telecommunication devices, electricity, networks or any additional networks capacity and/or any other conditions beyond the Bank's control or event of any force majeure, the Bank reserves the right to determine and/or to change the daily cut-off time, restrict, withdraw, cancel, suspend or discontinue any or all services following the applicable Laws and Policies in Indonesia. | | | The Bank shall not be liable to the Customer if the Customer is unable to gain access to the System. The Customer realizes and understands that although Citibank Online is a 24-hour service, but some or all of the services may not be available at certain times due to maintenance or malfunction of computer, telecommunication devices, electricity or network failure and/or ISP(s) and the Alert is dependent on the infrastructure, connectivity and services provided by the ISP(s) and CSP(s) engaged by the Bank. Customer accepts that timeliness, accuracy and readability of the services will depend on factors affecting the ISP(s) and/or CSP(s) and other factors outside the Bank control or any event of force majeure situations. Bank shall not be liable for non-delivery or delayed delivery of the Alert, error, loss or distortion in transmission of the Alert of Customer.If the Customer inserts the wrong ATM-PIN or Credit Card-Code for three (3) times consecutively, the Bank will block the ATM-PIN number or the Credit Card-Code and the Customer may request the Bank for a new ATM-PIN or a new Credit Card-Code at any of the Bank's customer service office or the 24-Hour CitiPhone Banking. | | | | Transaction Process -
| 1. | TRANSACTION DATE. Any Transaction(s) conducted after the daily cut-off time in Jakarta, Indonesia, shall be treated as Transaction(s) for the next Business Day or such other day as the Bank may determine at its absolute discretion to carry out such Transaction(s), and will be subject to Bank's usual processing time. This Transaction(s) will be treated as if Transaction(s) without using Citibank Online and may from time to time be amended. | | | 2. | RECEIPT. The Bank will not print or issue any statements or confirmation for any Transaction(s) conducted, but such Transaction(s) will appear in the monthly statement issued by the Bank to the Existing Customer. The Existing Customer may produce a print out of such Transaction(s) from Customer Terminal. | | | 3. | TRANSFERS & PAYMENTS. The Bank shall not be obliged to carry out any transfer or payment instructions unless the Existing Customer account(s) at the Bank has sufficient funds or credit balance to pay the relevant amount(s). For any and all Transaction(s) between Existing Customer(s) whether it is a transfer or a payment will be made instantly. Nevertheless, for any and all Transaction(s) between banks whether it is a transfer or a payment the amount of which will be deducted, from the Existing Customer account(s) at the next Business Day or such other day as the Bank may determine at its absolute discretion.The Bank cannot guarantee the time at which the receiving banks or billing organizations will debit the account(s) of the Existing Customer's payees. To avoid from incurring charges, the Existing Customer must initiate a transfer or payment sufficiently in advance of the due date of the payment. | | | | The Bank shall not be responsible for any charges incurred and/or any consequences resulted from the following situations: | | | | | | - The existing Customer does not have sufficient funds in its account(s) in the Bank to make a transfer or bill payment;
- An order of court or other competent authority or prevailing Laws prohibiting the Bank to withdraw from the Customer's account(s);
- The Customer's account(s) in the Bank is/are closed and/or any funds therein has/have been put on hold;
- The Existing Customer has not provided the Bank with complete and correct payment information, including without limitation the name, address, account(s) number and payment amounts for the payee on a bill payment and/or transfer amounts;
- The Existing Customer does not properly use Citibank Online; or
- A force majeure situation occurs (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer or bill payment, despite reasonable precautions taken by the Bank.
| | | | | The Bank has the right to terminate the Customer's transfers & payments conducted via Citibank Online facility at any time without prior notice. | | | 4. | SETTLEMENT. The Bank shall not print or issue any statement or confirmation for any Transaction(s) conducted via Citibank Online but such Transaction(s) will be recorded in the monthly statement issued by the Bank to the Existing Nevertheless the Existing Customer still can print out Transaction(s) via Customer Terminal. Notwithstanding what may be shown in any Customer Terminal or print-out, Transaction(s) is/are completed instantaneously if done before the cut-off time reckoned based on the cut-off time in Jakarta, subject to the provisions of Article 2.1 and 2.3 hereof. If it is done after the cut-off time, it will be completed at next Business Day, subject to the provisions of Article 2.1 and 2.3 hereof. The Transaction(s) details, account balances and other information as shown in any Customer Terminal or print-out are for reference only. Those Transaction(s) details and account balances as recorded by the Bank will be determined later on (for example there will be an adjustment to the balance, the type and amount of such Transaction(s) and the date and time it occurred). | | | | Alert -
| 1. | THE ALERT FACILITY. | | | | | | - The Existing Customer to request and receive SMS and/or E-Mail messages including but not limited to foreign exchange rate, product promotion and also available balance information and other issues relating to the balance & Transaction(s) history on all the Existing Customer's account(s); or
- The Temporal Customer to request and receive E-Mail messages including but not limited to Foreign Exchange rate, and product promotion.
| | | 2. | SCOPE OF ALERT. Customer may receive the Alert through SMS and/or E-Mail. | | | a. Short Messaging Service. | | | | - If Existing Customer request for this SMS Alert and approved by The Bank, it is his/her responsibility to determine if his/her CSP(s) support text messaging and his/her mobile phone is capable of receiving text message.
- This SMS is available in certain specific regions and to subscribers of mobile phones of certain specific CSP(s) and the Existing Customer understands that unless the Existing Customer is a subscriber of the specific CSP(s), the Alert will not be available.
- The Service may be extended to other cellular circles as well as to subscribers of other CSP(s), as will be notified by The Bank, from time to time.

Electronic Mail. | | | | | If Customer request for this E-Mail Service and approved by The Bank, it is his/her responsibility to determine his/her ISP(s) and to provide the capability of his/her personal computer with a system which is enable Customer to received an E-Mail. | | | | 3. | CONDITION PRECEDENT. The Alert is subject to the terms and conditions of Customer's agreement(s) with his/her CSP(s) and/or ISP(s). The Bank will not be concerned with any dispute between Customer and CSP(s) and/or ISP(s) and makes no representation or gives no warranty with respect to the quantity of the service provided by the CSP(s) and/or ISP(s) or guarantee for timely delivery or accuracy of the contents of each Alert. | | | Suspension/Cancellation and Unauthorized Use -
| 1. | SUSPENSION/CANCELLATION. After suspension or cancellation, the Bank by using Citibank Online facility may be reinstated at its sole and absolute discretion and the Bank reserves the right to impose a reinstatement charge. The Bank likewise reserve the right to impose a fee for any utilization of Citibank Online facility at its sole and absolute discretion based on the calculation determined by the Bank at any time without prior consent of the Customer. | | | The Existing Customer acknowledges and consents to authorize the Bank to act upon any instruction which is identified as the user of the Customer's CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code. The Bank shall be responsible for acting only on those instructions sent and received completely through Citibank Online facility, which such instructions are neither reviewed nor verified by the Bank prior to or following activation of this facility. The Bank is not responsible for any malfunctions in communications facilities not under the Bank's control that may affect the timeliness or accuracy of the instructions sent. | | | The Bank shall be entitled but not obliged to verify all the instructions received by e-mail, telephone or any other devices by using CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code of the Customer, but the Bank shall neither be liable for action upon such instructions sent nor be obliged to investigate the authenticity or authority of persons effecting the Existing Customer's instructions or verify the accuracy and completeness of the Existing Customer's instructions. Such instructions shall be deemed correct, complete, irrevocable and binding on the Existing Customer upon the Bank's receipt. | | | The Existing Customer hereby accepts full responsibility for all Transaction(s) executed via Citibank Online and in particular, in ensuring its accuracy and completeness.The Existing Customer acknowledges and agrees that The Bank may, without notice and without stating the reason therefore, cancel or refuse to execute any of the Existing Customer's instructions at any time without incurring any legal liability. | | | 2. | UNAUTHORIZED USE. The Existing Customer is responsible for keeping confidentially the CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code and the Existing Customer shall not disclose the CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code to any unauthorized person(s) and shall take all necessary actions to prevent from disclosing the CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code to any unauthorized person(s). The Existing Customer shall inform the Bank as soon as reasonably practicable if the Existing Customer knows or suspects that someone else knows the CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code or that unauthorized Transaction(s) have taken place or that the CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code has been lost or stolen and if the Existing Customer fails to do so the Existing Customer shall be liable legally for any unauthorized Transaction(s) made. | | | | The Existing Customer must promptly and precisely examine the monthly statement upon receipt and if the Existing Customer discovers any discrepancies, omissions, inaccuracies or incorrect entries, the Existing Customer must immediately call and inform 24-Hour CitiPhone Banking. The Existing Customer shall be liable for all losses prior to the Existing Customer's reporting any discrepancies, omissions, inaccuracies or incorrect entries or if the Existing Customer act fraudulently or with negligence, including failing to properly safeguard the CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code or not immediately reporting any unauthorized Transaction(s) which Transaction(s) directly or indirectly made. | | | 3. | INDEMNIFICATION. The Bank shall endeavor to provide this facility on a best effort basis and the Bank shall not be liable legally for non-availability of this facility or non-performance by any CSP(s) and/or ISP(s), and the Customer agrees to indemnify and hold the Bank harmless against any and all proceedings, claims, losses, damages or expenses (including legal costs) arising directly or indirectly from the following conditions: | | | | | | - The Bank action(s) upon any instruction(s) which is/are identified by as the user of CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code of the Customer;
- The improper or unauthorized use of Citibank Online facility including the Alert or any unauthorized use of CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code of the Existing Customer;
- Any damage to the Customer Terminal and/or Customer mobile phone, related to facilities or software as a result of any access to Citibank Online by receiving the Alert and/or using CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code of the Existing Customer;
- Any loss or damages caused by any information obtaining from the Alert or any access through CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code of the Customer at the time when the such access is prohibited, restricted, delayed or otherwise affected by
- any law or regulation of the country from where Citibank Online is accessed, terms and conditions prescribed by any relevant internet service provider or information service provider in such country; or
- any law or regulation of any jurisdiction, regional or international authority which governs any use of any component of Citibank Online, any relevant internet service provider, information service provider, or system;
- Any loss or damage caused by any act(s) and/or omission(s) of any relevant ISP(s) and/or CSP(s) or information service provider or network provider occasioned by any Alert received or any access through CitiCard number, Credit Card number, ATM-PIN and/or Credit Card-Code of the Existing Customer;
- Any loss or damage caused by any modification, alteration, upgrade or termination of Citibank Online occasioned by any access of the Alert or any access through CitiCard number, Credit Card Number, ATM-PIN, and/or Credit Card-Code of the Customer;
- Inability or delay in accessing and/or use of any browser which Bank provide to allow access to Citibank Online;
- Any errors or omissions in the information and materials contained in the Bank's web site; or
- Any delay, non-delivery, delayed delivery, or the misdirected delivery or failure of the Transaction(s) and/or Alert in any transmission, dispatch or communication facilities and inaccurate or incomplete content in the Transaction(s) and Alert.
| | | | This indemnity is unconditional and irrevocable. | | | 4. | JOINT ACCOUNTS. In case any account(s) which is/are accessible through Citibank Online is a joint or partnership account(s), the Existing Customer shall be responsible for the liabilities and obligations of the other account(s) holder(s) severally. | | | Limitation Liability & Information Corrections -
| 1. | LIMITATION OF LIABILITY. Subject to the provisions provided herein, if the Bank is held liable for any act(s) or omission(s) for any reason whatsoever, the Bank's liability shall be limited to the amount of the relevant transaction(s) or the Customer's actual damages whichever is less. And the Bank shall not be liable to the Customer for any direct or indirect loss or damages arising in any way from the use of Citibank Online facility. | | | 2. | INFORMATION CORRECTIONS. The Bank provides the Customer with information via Citibank Online, the Customer acknowledges and agrees that the Bank does not warrant the accuracy, of any such information. And nor does any information provided in the Bank website. | | | | Other Terms & Conditions -
| 1. | SECURITY. The Bank shall use the best effort(s) to ensure that Citibank Online is secure and cannot be accessed by unauthorized user(s). However, the Bank does not warrant the security, secrecy or confidentiality of any information or Alert transmitted through any relevant ISP(s) and/or CSP(s) and/or other network provider(s) in any jurisdiction via Citibank Online. | | | | The Customer shall notify the Bank immediately upon receipt of any data or information which is not intended to the Customer and shall delete such data or information from the Customer Terminal immediately. | | | 2. | TRANSFER OF INFORMATION. The Existing Customer hereby authorizes the Bank, in accordance with the Agreement entered into by and between the Bank and the Customer, to disclose any information on the Existing Customer account(s) to any of the Bank's office(s), subsidiary(ies), affiliate(s) and agent(s) or authorized third parties selected by the Bank. The Existing Customer further acknowledges that such office(s), subsidiary(ies), affiliate(s) and agent(s) or third party shall be entitled to disclose any information as required by any applicable law or as requested by any competent authority. The Existing Customer hereby holds the Bank free and harmless from any liability that may arise from such disclosure. | | | 3. | TERMINATION | | | | | | - The Bank reserves the right to terminate its facility herewith upon prior notification.
- Customer may at any time discontinue or unsubscribe to the said facility.
| | | | 4. | INTELLECTUAL PROPERTY RIGHTS. The Customer acknowledges that all proprietary rights relating to or in connection with Citibank Online (including without limitation to the Bank website) and any amendments thereof, including without limitation to trademark, service mark, patent and copyright, shall at all times remain the proprietary of the Bank.Citibank Online uses proprietary software of the Bank, other Citigroup affiliates and other software suppliers. The Customer agrees that the Bank has granted a non-exclusive license to use this software in connection with Citibank Online which allows the Customer to use such software only for its intended purposes. The Customer shall not disassemble, recompile, copy, modify or reverse engineer any such software or allow anyone else to do so | | | 5. | INDEPENDENT INTERNET SERVICE PROVIDER/CUSTOMER TERMINAL. The Customer understands that any access to Citibank Online will be effected depends on the relevant ISP(s) or CSP(s) or network provider in the region from where such service is accessed, consequently such access will also be subject to and governed by the relevant laws and regulations of that region and any terms and conditions prescribed by such relevant internet service provider or network provider. | | | The Customer represents that to the best of his/her knowledge that the Customer Terminal and any other computer system and/or mobile phone through which access may be effected by any use of the Alert received, CitiCard number, Credit Card number, ATM-PIN, and/or Credit Card-Code are free from any disruption of electronic, mechanical, data failure or corruption, computer viruses and bugs. The Customer acknowledges and agrees that neither the Bank, nor any of the Bank's officers and employees or any affiliate or subsidiary of Citigroup, Inc., is responsible for any disruption of electronic, mechanical, data failure or corruption, computer viruses and bugs or related problems that may be attributable to the services provided by any relevant ISP(s) or CSP(s). | | | 6. | AMENDMENTS. | | | | | | - Nothing contained herein shall amend, supersede or nullify anything contained in any other agreement Customer has made with The Bank.
- The Terms and Conditions mentioned hereof shall be amended at any time without prior notice in any mean or with notice on demand and such amended terms and conditions will thereupon apply to an be binding on Customer.
| | | | 7. | LEGAL LANGUAGE. This Terms and Conditions have been drawn in English Language. In the event of any dispute arising from an alleged difference in interpretation between the English text and any other translated text, the English test shall be considered as the official text. | | | 8. | ENTIRE AGREEMENT. This Agreement shall be an integral part of the General Terms and Conditions Governing Citibank N.A, Indonesia Accounts, the Terms and Conditions for the Issuance and Use of Citibank Credit Cards, and such other rules and regulations governing the Customer account(s) with the Bank and shall be applicable to any future account(s) which the Customer may hereafter open with us. | | | 9. | GOVERNING LAW. This Agreement shall be governed and construed under the laws of the Republic of Indonesia, and for the implementation of this Agreement and all its consequences, both parties hereby select and choose general and permanent domicile at the Registrar's Office of the District Court having jurisdiction over the Bank where the Exisiting Customer opened account of where Temporal Customer register for the Alert, and Indonesia law shall apply, unless the Bank as plaintiff should give preference to the foreign court and foreign jurisdiction, such as foreign court and/or jurisdiction shall apply.
